Guardianship Solicitors Paisley, Scotland

If you would like to be more involved in caring for a loved one who has lost capacity to act and make decisions, you may be considering Guardianship. The decision to become someone’s Guardian is a serious one. It involves applying to the courts to be granted the legal authority to make decisions and act on the behalf of someone who lacks mental capacity. If your loved one has capacity, they may wish to consider Power of Attorney. Guardianship is a significant responsibility that involves safeguarding another individual and promoting their interests in respect of their personal welfare, financial affairs or property.

When applying for Guardianship, it’s necessary to clearly specify the financial and/or welfare powers you will need in order to carry out your role as a Guardian effectively. These include the power to manage financial affairs or property and the power to make decisions related to their care or long-term health. It is also necessary to demonstrate to the court that Guardianship is in the best interests of, and will benefit, the individual you hope to take legal authority for.

If Guardianship is granted, you will have contact with supervisory bodies, such as the Office of the Public Guardian and the local authority, to ensure that the terms of the Guardianship Order are being observed.

Director and solicitor Steven Millar has considerable experience in advising and assisting a number of families facing the incapacity of a relative. He has been in private legal practice for over 31 years and draws on his considerable experience when helping clients navigate the process of applying for Guardianship.
